ACCEPTANCE OF TERMS AND CONDITIONS OF SALE
The website www.aqua-swimwear.mu is operated by Sport Plus Co Ltd.
Any order validated by any user (hereafter referred to as “User,” “Customer” or “You”) implies the prior acceptance of these terms and conditions.
These terms and conditions are intended to define the rights and duties of the parties (AQUA and the client) under the online sale of goods & services offered by AQUA Swimwear to the customer.
When the customer validates his order on the site, he declares to have acknowledged and accepted all the terms and conditions of sale. AQUA agrees in turn to respect the terms it has committed to under the present agreement.
The products offered by AQUA comply with current Mauritian legislation and standards.
The product remains the property of AQUA until the billing of the whole amount due has been received by AQUA.
When you validate the order by selecting a mode of settlement, the sale is concluded (agreement on the good and price).
On the website, the prices of our products are displayed in Mauritian Rupees and TTC (All Taxes Included). AQUA reserves the right to modify its prices at any time.

There are a few stages to process an order:
- Make your choices and validate your basket
The customer selects online products under his sole responsibility by detailing the references of selected products and their quantity.
- Complete identification section
- Complete delivery information
The customer will specify his name, phone number and delivery address.
The customer is required to specify any special circumstances relating to the delivery address which may complicate the delivery of the ordered product.
- Choose your payment method.
Once selected, payment must be made to formalize the order.
- Accept the terms and conditions of sale by checking the box provided for this purpose.
Customer can modify or cancel his order before sending it to AQUA Swimwear.
The customer will receive an email to confirm the reception of the order by AQUA Swimwear.
All orders are subject to our acceptance. All products are supplied within the limits of available stocks.
Should a product be unavailable after the order has been placed, AQUA will contact the customer by email or by phone using the contact details that were given in the purchase order. The customer shall be offered a similar product.
If the customer refuses the substitute product, the order can be cancelled. The customer will then receive a refund within a maximum of 30 days, starting from the date of substitute product refusal.
MODE OF PAYMENT
Payments are made exclusively online, at the time of ordering, by credit card (Visa or Mastercard). AQUA swimwear does not have access to your credit card details and does not keep them on its servers. Incidentally, that’s why you will be asked to provide your details for every new transaction on our website.
Providing your credit card number to the bank server at the time of payment for your order is completely secure. AQUA’s secure payment service incorporates the security standard SSL (Secure Socket Layer).

AQUA swimwear reserves the right to refuse an order if the customer is involved in a pending settlement dispute or if the customer has not settled an ongoing order.
The products ordered from AQUA’s online website are delivered directly to your home through a specialized carrier (UPS/LAPOSTE or DHL, thus guaranteeing quality delivery.
The products will be delivered to the address mentioned by the customer at the time of the order.
Any delivery costs to Mauritius as well as internationally will be added to the price of the selected products at the end of the order process.
AQUA cannot be held liable in the event of a delay in delivery.
Therefore, no compensation can be claimed by the customer to AQUA.
In case delivery cannot be achieved on the scheduled date due to unspecified special circumstances or input errors made by the customer during the order, AQUA reserves the right to postpone or cancel the order.
All costs related to the delay or cancellation of the order will then be charged exclusively to the customer.
The average delivery time is 2 to 4 working days as from the date the order is received.
For international delivery, the average delivery time is 5 to 15 working days. This is an average time frame comprised of the time it takes to process, prepare, and deliver the order to the customer. Deliveries of products internationally may be subject to possible taxes and customs duties upon receipt of the package. The customer is required to inquire about potential customs duties and fees applicable to his situation when ordering. Customs duties and any other fees are the exclusive responsibility of the customer.
RIGHT OF CANCELLATION
You must be totally satisfied with the products offered by AQUA!
That’s why we always provide every customer and every order with the maximum amount of care.
However, the product you receive may not meet your expectations.
In accordance with the legal provisions in force, the customer is able to exercise his right of cancelation under a period of 14 days from receipt of the products or its removal from the shop and return it to AQUA without stating a reason or paying any fees.
Beyond this date, the products will be considered to have been duly accepted by the customer and AQUA reserves the right to refuse to offer an exchange, a credit, or a refund.
Returns will only be accepted if the product return procedure is followed by the customer:
- The products must be returned in their original packaging and in perfect condition allowing its re-marketing as new.
- Return will be refused if returned products are unsuitable for re-marketing
- AQUA cannot be held responsible for damages resulting from the customer’s misuse of the products.
Once the delivery has been made by the carrier, the customer can either return the products by his own means, or, if he is unable to do so, AQUA provides the customer and at the customer’s expense a recovery service at original delivery cost excluding possible discount.
The return costs will be the exclusive responsibility of the customer.

SALES / PROMOTION:
When AQUA products are on Sales, the customer is able to exchange his products under a period of 6 days, the exchange will need to be done directly at the showroom in the North. AQUA will refuse to offer an exchange, after this date.
If any exchange occurs, the customer will have to choose another promoted item.
No refund will be accepted during a sales period.
The data collected by AQUA will be used only to deliver the order, which may be transferred to some of our service providers (UPS, DHL, LA POSTE) as part of the order and delivery process. All personal data will be treated with the strictest confidentiality and your lawful interests will be considered.
The data provided will strictly be used for advertising purposes specific to AQUA if you have signed up for our newsletter. You can object to your data being used for advertising purposes at any time by sending an email: email@example.com
Aqua will give the customer a password to access their customer account. This password is personal and confidential. The customer is solely responsible for the use and confidentiality of this password. AQUA rejects liability for fraudulent use of this password.
AQUA rejects any legal liability in the event of breach of its contractual obligations resulting from a case of force majeure or unforeseen circumstances.
Cases considered to be force majeures cases are as follows: internal or external social conflicts, fires, natural disasters, strikes within the company or subcontractors or contractors or carriers, internal or external breakdowns and in general any event that could affect the execution of an order.
By visiting www. aqua-swimwear.com, you accept that Mauritian law governs these Terms and Conditions of sales. In case of a disagreement between the customer and AQUA, with professionals and/or retail traders; the parties will seek an amicable settlement to any disputes arising from the execution of these Terms of Sale.
In lack of an amicable agreement, the dispute will be subject to Mauritian law and each party will exclusively recognize the competence of the Mauritian courts.
